Welcome to DineSpotter.
These Terms and Conditions (“Terms”) govern your access to and use of the DineSpotter website at dinespotter.co.uk and the services and features we make available through it.
In these Terms, “DineSpotter”, “we”, “us” and “our” refer to DineSpotter.
By using DineSpotter, creating an account, submitting or claiming a restaurant listing, or purchasing a paid service, you agree to these Terms.
Please read them carefully before using our services.
DineSpotter is a UK restaurant discovery and directory platform designed to help diners discover restaurants, cafés, takeaways and other food businesses.
We also provide restaurant owners and authorised representatives with tools to create, claim and manage restaurant listings and access additional features according to the services or plans available to them.
DineSpotter is a discovery platform and, unless expressly stated otherwise, is not the restaurant, food provider, booking provider or delivery provider for businesses displayed on the platform.
Certain DineSpotter features may require you to create an account.
When creating or using an account, you agree to:
Provide accurate and current information.
Keep your account information reasonably up to date.
Keep your login credentials secure.
Not allow another person to misuse your account.
Notify us if you believe your account has been accessed without permission.
You are responsible for activity carried out through your account where reasonably attributable to your use or failure to keep your login details secure.
You must not use DineSpotter:
For unlawful or fraudulent purposes.
To impersonate another person or falsely claim to represent a restaurant or business.
To submit deliberately false or misleading information.
To upload content that infringes another person’s intellectual property or other legal rights.
To distribute spam, malware or other harmful material.
To attempt to gain unauthorised access to DineSpotter, its accounts, servers or systems.
To interfere with or deliberately disrupt the operation or security of the website.
To scrape, copy or systematically extract substantial parts of DineSpotter except where permitted by law or with our written permission.
We may take reasonable action where we believe these Terms have been breached.
DineSpotter may contain restaurant and business information supplied by business owners, users, third parties or publicly available sources.
Restaurant information may include:
Business name and location.
Contact information.
Opening hours.
Menus.
Photographs.
Cuisine and category information.
Website and social media links.
Booking, ordering or enquiry options where available.
We aim to provide useful restaurant information, but restaurant information can change.
We do not guarantee that every listing will always be complete, accurate or current.
Restaurant owners or authorised representatives who create, claim or manage a listing are responsible for ensuring that information they submit is accurate and that they have the authority to manage the relevant business profile.
We may correct, update, restrict or remove listings where reasonably necessary, including where information appears inaccurate, misleading, duplicated, unlawful or inconsistent with these Terms.
Where a restaurant is already listed on DineSpotter, an owner or authorised representative may be able to request management access through our claiming process.
You must not claim or attempt to manage a business that you do not own or have authority to represent.
We may request information reasonably necessary to verify your connection with a business before granting management access.
Submitting a claim does not guarantee that the claim will be approved.
We may reject, suspend or reverse management access where we reasonably believe that a claim is unauthorised, fraudulent or based on inaccurate information.
Certain DineSpotter features may allow users or restaurant owners to submit content such as photographs, restaurant information, menus, comments, ratings or reviews.
You retain ownership of content that belongs to you.
By submitting content to DineSpotter, you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format and otherwise use that content as reasonably necessary to operate, promote and provide DineSpotter and its services.
This licence lasts for as long as the content remains on our platform or as reasonably necessary for technical, legal or backup purposes.
You must have the necessary rights or permissions to submit any content you upload.
You must not submit content that is unlawful, defamatory, fraudulent, threatening, discriminatory, infringing or deliberately misleading.
We may remove or restrict content where we reasonably believe it breaches these Terms, applicable law or our content policies.
Where reviews or ratings are available, they should reflect genuine experiences and must not be submitted for fraudulent or manipulative purposes.
Businesses must not submit fake customer reviews or improperly manipulate ratings or reviews.
We may moderate, restrict or remove reviews that we reasonably believe breach these Terms or our applicable community or content guidelines.
The opinions expressed in user reviews belong to the users who submit them and do not necessarily represent the views of DineSpotter.
DineSpotter may offer free and paid plans for restaurant owners.
The features, prices, billing periods and limits applicable to each plan will be shown on the relevant pricing or purchase page at the time of purchase.
Features may vary between plans and may change over time. Where a change materially affects a paid service already purchased, we will deal with that change in accordance with the applicable agreement and law.
Restaurant owners are responsible for reviewing the applicable plan information before purchasing.
Where payment is required, payments may be processed through a third-party payment provider.
Payment providers may have their own terms and privacy policies.
You agree to provide accurate billing and payment information when purchasing a paid service.
Prices and applicable billing periods will be displayed before you complete a purchase.
Nothing in these Terms affects any refund, cancellation or other rights that you may have under applicable law.
Any additional cancellation or renewal terms applicable to a particular paid plan should be displayed during the purchase process or otherwise communicated to you before purchase.
Restaurant listings may provide access to booking, ordering, delivery, messaging, websites or other services operated by restaurants or third parties.
Where a transaction or service is provided by a restaurant or third party rather than DineSpotter, your relationship for that transaction is with the relevant provider.
That provider may apply its own terms, cancellation policies, privacy policies and charges.
DineSpotter is not responsible for the performance of independent restaurants or third-party services, except to the extent that responsibility cannot lawfully be excluded.
You should review the applicable provider’s information before making a booking, placing an order or completing a transaction.
The DineSpotter name, branding, website design, original text, graphics, software and other materials created by or for DineSpotter are owned by us or used under licence and are protected by applicable intellectual property laws.
You may use DineSpotter for your own lawful personal or business purposes in accordance with these Terms.
You must not reproduce, distribute, sell, commercially exploit or create unauthorised derivative works from protected DineSpotter content without our permission, except where permitted by law.
Restaurant names, logos, photographs and other third-party materials remain the property of their respective owners where applicable.
We aim to keep DineSpotter available and functioning properly, but we cannot guarantee uninterrupted or error-free access.
We may occasionally need to:
Carry out maintenance.
Fix technical problems.
Update features.
Improve security.
Modify or discontinue features.
Where reasonably possible, we will seek to minimise disruption to users.
Restaurant details, menus, prices, opening hours, availability, photographs and other information can change.
Users should confirm important information directly with the restaurant or relevant service provider before travelling, ordering, booking or making purchasing decisions.
Nothing on DineSpotter should be treated as a guarantee that a particular restaurant, menu item, price, booking slot, promotion or service will be available.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
Subject to applicable law, DineSpotter is not responsible for losses caused by circumstances outside our reasonable control or by the independent acts or omissions of restaurants, users or third-party service providers.
If you use DineSpotter for business purposes, we will not be responsible for indirect or consequential business losses, loss of profits, loss of business, loss of anticipated savings or loss of business opportunity to the extent permitted by law.
Nothing in these Terms is intended to exclude or restrict any statutory rights or other legal rights that cannot lawfully be excluded or restricted.

We may suspend, restrict or terminate access to an account or listing where reasonably necessary, including where:
These Terms have been materially or repeatedly breached.
We reasonably suspect fraud or unauthorised activity.
A business claim cannot be verified.
Content creates a legal or security risk.
We are required to do so by law.
Where appropriate and reasonably practicable, we may provide notice or an opportunity to resolve the issue.
Termination does not affect rights or obligations that arose before termination.
Our collection and use of personal information is explained in our Privacy Policy.
Our use of cookies and similar technologies is also described through our applicable privacy and cookie information.
By using DineSpotter, you should review these policies alongside these Terms.
DineSpotter may contain links to websites and services operated by third parties.
These links are provided for convenience and restaurant discovery purposes.
We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.
You should review the terms and policies of any third-party service you choose to use.
We may update these Terms from time to time to reflect changes to DineSpotter, our services, applicable law or business requirements.
When we update these Terms, we will change the “Last Updated” date shown at the top of this page.
Where a change materially affects an existing paid service or users’ rights, we will provide any notice required by applicable law.
These Terms are governed by the laws of England and Wales.
If you are using DineSpotter as a consumer, you may also have rights under the mandatory laws applicable where you live, and nothing in these Terms is intended to remove rights that cannot legally be excluded.
Any dispute will be subject to the courts having jurisdiction under applicable law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
These Terms, together with any additional terms that apply to a particular service or paid plan, form the agreement governing your use of DineSpotter.
